We offer two ATE insurance options for civil cases; civil litigation is our leading product, and we also offer civil direct, a delegated product for lower value cases.

How does civil litigation work?

Civil litigation is an individually assessed ATE product suitable if you prefer to take a case-by-case approach, and require higher levels of cover for your clients.

What types of cases can be insured?

Civil litigation is available for a variety of civil or commercial cases, including:

  • Contentious probate
  • Contract disputes
  • Professional negligence
  • Debt recovery
  • Insolvency
  • Property disputes
  • Defamation
  • Financial disputes
  • Intellectual property disputes
  • Construction disputes.

What does civil litigation include?

It covers the other sides’ costs and disbursements and your client’s own disbursements if the claim is lost or discontinued. It also covers full ‘Part 36’ cover, and counsel’s fees provided they are not acting under a Conditional Fee Agreement.

What’s the level of insurance?

We offer a wide range of indemnity levels, which are competitively priced. If we’re able to cover the claim, we provide an individually assessed quote upon each application.

What criteria does a case have to meet?

There are no set criteria, and as long as your client is signed up to a valid retainer, each case will be individually assessed – without charge - by our experienced team.

How much does it cost? (general terms)

This depends on the details of the case. Civil litigation premiums are deferred and self-insured, with the cost of the policy varying depending on the case type and stage of litigation.
